Changes to Employment Tribunals

As the attacks on working rights continue fees will be introduced to make an employment tribunal claim from 2013 the information I have here is below.  On top of this we also are facing cuts in facility time.   Basically low paid and part time workers who are not in a union in many cases wont be able to afford to make a claim, for unions themselves it means an increased financial burden which in the case of smaller unions could mean some financial difficulty

Issue Fee £160.00 Level 1 Claim
Issue Fee £250.00 Level 2 Claim
Hearing Fee £230.00 Level 1 Claim
Hearing Fee £950.00 Level 2 Claim

Just to clarify Claims such as Unfair Dismissal, All Discrimination Claims, Trade Union Rights like denial of time off all come under Level 2

Level 1 Claims are in the main more straight forward ones like unlawful deduction from wages but any variation at all to complicate it will mean it will switch to level 2 Basically almost all cases as most employment tribunals by there very nature are in the main complex. 

Multiple claims will have a higher Fee for example were there is 200 claimants involved in say a equality of pay issue this will be limited to 6 times the individual case fee  Please note these fees are paid upfront of course.  Further fees are also planned.

This is often the sort of information that many miss often overshadowed by the bigger issues that are ongoing but these kind of changes that are not the headline grabbers like other issue are also part of the onslaught we are facing.  

The potential for this of course is as employers gain more confidence in the fact workers are less likely to take an employment tribunal we may see an increase in things like workplace bullying and discrimination  and an increased move towards a hire and fire culture
