Sick workers must ask for holiday

Sick workers must ask for holiday

5 January 2012
PCS members should make sure colleagues on long-term sick tell bosses that they want to carry their holiday entitlement over into the next leave year.

Workers who are ill continue to accrue statutory holiday thanks to a European Court judgment in a case taken by PCS on behalf of a member in Revenue and Customs.
Leave can be carried over - but the UK Employment Appeal Tribunal has ruled that if an employee does not make a specific request for that to happen they lose their entitlement.
The decision will probably be appealed.

But in the interim PCS is advising members on sick leave to make an application in writing to their employer, before the end of their current leave year, asking to carry holiday forward.
